SC clears way for eviction from Cox’s Bazar beach


The Supreme Court on Monday cleared the way for evicting structures from the Cox’s Bazar sea beach.

The seven-member bench of the Appellate Division upheld a High Court order vacating its earlier order that had stayed a deputy commissioner’s (DC’s) notice to evict the structures.
The HC of Justice AHM Shamsuddin Chowdhury Manik and Justice Sheikh Md Zakir Hossain on January 10 this year directed the DC and superintendent of police of Cox’s Bazar to remove or evict the structures from the sea beach.

The DC on January 12 issued a notice asking the owners of hotels and restaurants at the sea beach to evict the structures within a week.
The owners of four hotel and restaurants filed separate writ petitions with the HC challenging the DC’s notice.

Another HC bench on January 17 stayed the DC’s notice.
Later on, the HC bench of Justice AHM Shamsuddin Chowdhury Manik and Justice Sheikh Md Zakir Hossain following separate petitions filed by the ministry of land vacated the HC order staying the DC’s notice.

The hotel owners recently filed four separate petitions with the SC for staying the HC order.
The Appellate Division on Monday dismissed their petitions.
